Terms and Conditions

These terms govern orders placed through the Ventova Design online shop.

Deutsche Fassung lesen

This translation is provided for convenience. The German version is authoritative to the extent permitted by law. Mandatory consumer rights and any expressly agreed contract language remain unaffected.

1. Provider and scope

Your contracting party is Simon Fries, sole proprietor, trading as Ventova Design, Bergstraße 1, 97517 Rannungen, Germany.

These terms apply to contracts for goods with consumers and businesses. A consumer is a natural person acting mainly outside their trade or profession.

2. Offer and formation of contract

Product presentations are invitations to place an order, not binding offers. You can review and correct your details in Stripe Checkout before submitting the order. By pressing the final button indicating an obligation to pay, you submit a binding offer.

An automated receipt or payment confirmation does not constitute acceptance. We accept your offer by sending an express order confirmation or dispatching the goods.

3. Contract record and corrections

Order data is retained as required by law and sent to the email address provided. These terms remain available on the website. We do not provide additional individual online access to the contract record.

4. Prices, shipping and payment

Prices shown to consumers are total prices in euros including statutory VAT. Shipping to the offered EU destinations is free unless a different charge is clearly shown before checkout.

Payments are processed by Stripe using the methods displayed at checkout. Additional terms of the selected payment service may apply.

5. Delivery and pre-orders

We deliver to the address entered at checkout within the offered EU countries. Processing and delivery times are stated on the product page and in our Shipping and Payment Information.

For products expressly marked as pre-orders, the stated estimated delivery period applies. We will notify you of delays without undue delay. Statutory rights remain unaffected.

6. Custom enquiries and made-to-order goods

A custom-product enquiry is not an order. A contract is formed only when a separate quotation is accepted.

The statutory right of withdrawal may not apply to non-prefabricated goods made to the consumer’s specifications or clearly personalised. We will identify this before the contract is concluded.

7. Retention of title

Goods remain our property until payment has been made in full.

8. Defects

Statutory rights relating to defective goods apply. Any additional guarantee applies only where expressly stated for a product.

9. Liability

Liability is unlimited for intent, gross negligence, injury to life, body or health, under product-liability law, and within guarantees assumed.

For slight negligence affecting an essential contractual duty, liability is limited to foreseeable damage typical for the contract. Liability for other slight negligence is excluded.

10. Right of withdrawal

Consumers have the statutory right of withdrawal described in our Cancellation Policy.

11. Contract languages

Contract processing is available in German and English. The German version of these terms prevails where legally permissible. Mandatory consumer protection and any contract language expressly agreed in an individual case remain unaffected.

12. Governing law and dispute resolution

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Consumers retain the protection of mandatory provisions of their country of habitual residence.

We are neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration board.
